MAINTENANCE CONTRACTS – TERMS AND CONDITIONS

  1. All prices quoted are exclusive of vat
  2. Prices exclude M.C.D ( Main Contractors Discounts) unless otherwise stated
  3. Prices are fixed for a period of 3 months
  4. We recommend that Flooring substrates consisting of sand/ cement screed should always be prepared with a minimum of 8mm pumped screed screed.
  5. Costs given are for continuous working during normal hours (Mon-Fri, 8am-5pm)
  6. Costs are subject to verification of a site re-measure where applicable
  7. Payment terms are as stated on the quotation.
  8. Late payment will incur a 2.5% interest charge per month until amount is paid in full.
  9. Trimming of doors are excluded from any quotation / estimate and will incur a further charge.
  10. Day work to be charged at £40.00 per hour per man.
  11. Additional materials/plant to be charged at trade + 15%
  12. During the winter months, it is essential that the heating system is operational before any installation. Failure to ensure this may cause irreparable damage to the floorcovering of which Maintenance Supplies Contracts cannot accept any responsibility.
  13. Our quotation includes for work as detailed only. Any changes or additions to the description hereto will be costed accordingly.
  14. Our quotation is based on cleared areas only unless stated. Any delays due to the floor area being inaccessible will be charged at the hourly rate per man per hour
  15. The Client is responsible for re-routing of all cables, wires etc. That may run across the sub floor before installation of new floorcovering. If this prevents an installation proceeding on a booked installation date, this could incur a cancellation charge or waiting time charge. Maintenance Supplies Contracts accepts no responsibility for damage to wires or cables during installation
  16. Concrete floors that can be subject to air coming up through the surface. This can be due to the floor not having a DPM or may be due to the unique nature of that floor. If this causes bubbles in the resin finish it is beyond our control and is a natural consequence of having a resin manufactured floor on site and not a preformed surface made under consistent conditions.
  17. Floors are prepared by either diamond grinding or vacuum shot blasting. If a coating is applied to the floor subsequently then the preparation marks can generally be seen in the resulting profile of the floor. This is quite normal and is a consequence of a coating having been applied that is approx. 0.5mm thick. Thicker systems like SL’s and pumped screeds will make these prep marks invisible.
  18. MSC are not responsible for movement in the substrate which causes cracks or hollow area in a floor after we have installed a coating or screed. MSC are floor layers and not structural engineers. The client is responsible for the structural suitability of the substrate.
  19. All resin screeds, resin coatings and pumped screeds are made and installed by mixing liquids and solids together and applying in a way to get as consistent a surface finish and view as possible. However, due to site conditions, variation in pigments, and differing aggregate content variations in colour, texture and overall appearance can occur. These are often beyond the contractor’s control.
  20. Osmosis in flooring is a rare but natural phenomenon that appears as small blistering in the floor surface. These blisters are caused by ground air pressure coming up and through the floor slab. Often this can also bring a brown residue with it that is ground water being forced up by the rising moisture air mixture. This phenomenon is beyond the contractor’s control.   21. Please note: liquid pumped screed provides a smoothing compound that follows the contours of the sub floor; it is not a levelling compound. We can lay floors to datum levels, but this must be stated in the quotation details.
  22. Linoleum Floors; All linoleum installations may incur a phenomenon known as stove yellowing. This may cause the flooring to appear slightly more yellow or darker when first installed. Exposure to light after installation will cause the flooring to achieve the correct colour. This process may take up to 3 months and is entirely normal. However it is more noticeable with the lighter colour ranges
  23. All goods remain the property of Maintenance Supplies Contracts Ltd until paid for in full
  24. Please note; If we are working through a main contractor for a third party, these term overrides all other considerations and maintains the goods as the property of Maintenance Supplies Contracts to incorporate this condition within its terms and conditions with their Client
  25. Maintenance Supplies Contracts reserves the right to levy a surcharge of £200.00 per man per day if the Client changes an installation date within seven days of the agreed date
  26. The Order is subject to written confirmation and/or order number
  27. On site work the main contractor will be responsible for providing lights, electricity and clear access
  28. On site the main contractor, if required, will make provisions for safe and secured storage of the flooring products and at all times will be responsible for the health and safety of our operatives on their site.
  29. Your instruction for us to proceed on site is your declaration that the site is to the relevant following standards: BS CP102 – BS 5325 – BS 8203 – BS 8204 and any variation as they become available. Maintenance Supplies Contracts cannot accept any responsibility for your subsequent acts or omissions. If you have any doubts queries or concerns, you should refer to the relevant regulations and take further professional advice.
  30. Except in the case of death or personal injury caused by our negligence, liability under or in connection with this or any other agreement between Maintenance Supplies Contracts Ltd and the client whether arising in contract, tort, negligence, breach of statutory duty or otherwise, shall not exceed the sum of the replacement value of the work involved.
  31. Neither Maintenance Supplies Contracts Ltd or the client shall be liable to the other in contract, tort, negligence, breach of statutory duty or otherwise of any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by the other of an indirect or consequential nature including without limitation any economic loss or other loss of turnover profits, business or goodwill.
  32. All prices quoted are subject to zero % retention unless previously agreed prior to commencement of work.
  33. PPE is provided by Maintenance Supplies Contracts to their own operatives and take no responsibility for client employees/visitors/personnel on site that do not have the required PPE whilst the work is being undertaken in the vicinity.
